Course Overview

This course covers the offences and penal framework under Chapter XVI of the Customs Act, 1962. It examines confiscation of improperly imported goods (Section 111) and improperly exported goods (Section 113), penalty provisions for improper importation and exportation (Sections 112 and 114), confiscation of conveyances and packages (Sections 115–118), penalties for various contraventions (Sections 114A, 114AA, 116–119), and prosecution provisions including cognizance of offences, presumption of culpable mental state, and offences (Sections 132–140A).
